Government of Republic of Kosovo holds 138th regular meeting

Chaired by Prime Minister Hashim Thaçi, the Government of the Republic of Kosovo held its regular meeting today and approved the Draft Amnesty Law, the Draft Law on International Legal Cooperation and the Government strategy on cooperation with the civil society.

The Government cabinet approved the Draft Law on Amnesty and returned it for resend it for approval to the Assembly of Kosovo.

Deputy Prime Minister and the Minister of Justice, Hajredin Kuçi presented the changes made to the Draft Law on Amnesty informing that Article 3 has been fully removed and that an Article has been added which reads that “all the criminal offences that resulted in bodily harm or murder will not be amnestied.”

“I also want to say that during the meeting today with other political parties, with LDK and AAK we agreed that this draft law is proceeded to the Assembly so that the Assembly of the Republic of Kosovo approves it next week,” said Deputy Prime Minister Kuçi.

The second draft law approved today in the meeting of the Government of Kosovo was the one on international legal cooperation. The draft law regulates the requirements and procedures for international legal cooperation in criminal matters between the Republic of Kosovo and other states, unless otherwise defined by various international agreements.

According to the draft law, international legal cooperation can also be implemented in relation to international organizations or institutions, if appropriate. In the absence of an international agreement between the Republic of Kosovo and other states, international legal cooperation can be provided based on the principle of reciprocity.

Judicial procedures related to international legal cooperation are regulated with criminal procedure provisions, unless otherwise provided for by this Law. The Republic of Kosovo is to apply the explicitly expressed formalities and procedures by the requesting state, if such formalities and procedures are not in contradiction with the basic principles of the national law.

The strategy on cooperation with the civil society 2013-2017, approve today by the Government Cabinet, intends to find forms of cooperation and the involvement of the civil society in policymaking and support of the civil society organization.

The Government of Kosovo commits itself through drafting of this strategy to:

• recognize and acknowledge role and the work of the civil society in building a democratic society;
• create a friendly and supportive environment for the development of the civil society;
• establish government mechanisms that allow a structured cooperation between the government and the civil society;
• clearly define roles and obligations of each government institution in relation to this cooperation;
• define monitoring mechanisms of the implementation of this strategy, and
• encourage the civil society to apply principles of good governance within the sector, improving promotion of a constructive and professional approach towards the public and government institutions.
