178th meeting of the Government of the Republic of Kosovo

The Government of the Republic of Kosovo held its regular meeting in which:

– Approved the draft law for the amendment and completion of the Special Laws for the Creation of the Legal Basis for the Issuance of Bylaws by the Government and Ministers. The draft law before us paves the way for the guarantee of the principle of the legality of by-laws, in the sense of prohibiting the arbitrary action of all bodies, which can intervene in the relations between the subjects of the law only on the basis of authorizations acquired by law. This also derives from the Rule of Law Checklist, issued by the Venice Commission, where the obligation of institutions to act in strict compliance with the powers defined by law is expressly defined.
– Approved the draft law for the Ratification of the Agreement between the Republic of Kosovo and the European Union on the Participation of Kosovo in the EU Program “Citizens, Equality, Rights and Values. This EU Program aims to support and develop open, equal and inclusive societies based on rights and the rule of law.
– Approved the draft law for the Ratification of the Agreement between the Government of Kosovo, represented by the Ministry of Finance, Labor and Transfers and the Government of the Swiss Confederation, represented by the State Secretariat for Economic Affairs for the “Climate Sustainability in the Water Sector in Kosovo” Project. This project will strengthen the capacities of national actors and regional water companies, to promote a climate-friendly environment in the provision of water services. It also promotes the reduction of unbilled water, contributes to energy efficiency and the use of renewable energy.
– Approved the draft law for the Ratification of the Financing Agreement between the Government of Kosovo, and KFW Frankfurt Am Main, for the Solar Energy Program I. In line with the green energy transition, the agreement between our Government and the German Development Bank includes the construction of a solar plant with an installed capacity of up to 100 MW and about 152 GWh of production per year. Before its installation, about 150 hectares of the former ash dump near the Kosovo power plant will be revitalized.
– Approved the draft law on the amendment and completion of the Law on Notary. It addresses issues of the notary system related to the conditions for exercising the duty of a notary, the conditions for the organization of the notary exam, but also the strengthening of the disciplinary system. These changes regulate aspects of the provision of notarial services in electronic form, which facilitates access to these services for citizens and increases the efficiency of the work of notaries.
– Approved the Draft Law on Sports. Through the reform of the sports system, this draft law aims to create better opportunities for participation in physical activities and sports, to contribute to the elimination of inequalities and discrimination on the basis of gender, race and ethnicity, as well as to focus on a safe environment, which promotes the health and well-being of athletes.
– Approved the draft law of Roads.
– Approved the draft law on State Border Control, which aims to define the rules for state border control and the powers and authorizations of the Police in relation to border control.
– The Draft Law on Private Security Services, through which the rules related to activities related to private security, including the protection of persons, objects and certain spaces, will be determined specifically.
– Approved the regulation for the amendment and completion of the Regulation on the Duties, Responsibilities and Procedures of the Commissions of the Kosovo Agency for Property Comparison and Verification.
– Approved the regulation on the Rules and Procedures regarding Property Administration and Implementation of the Voluntary Rent Scheme of the Kosovo Agency for Property Comparison and Verification. The drafting of this draft regulation concerns the administration of properties and the fulfillment of the recommendations of the People’s Advocate, which refers to the protection of property rights according to the Constitution of Kosovo and European and international human rights instruments.
– Approved the regulation for Informality Handling Procedures by the Kosovo Agency for Property Comparison and Verification. This regulation aims to determine the procedures, notification and information of the parties related to the legal recognition of informal property rights. The main objective of drafting this draft regulation is the formal recognition of property rights, acquired before March 24, 1999, as a result of an informal transaction, a problem that burdens many citizens of the Republic of Kosovo.
– Approved the regulation on Duties, Responsibilities and Organization of the Executive Secretariat of the Kosovo Agency for Property Comparison and Verification. This draft regulation also includes the acceptance, registration and comparison of the original cadastral documents scanned before June 1999. So, the documents that were received from Kosovo by the Serbian authorities.
– Approved the regulation on the Duties and Responsibilities of the State Training Center for Cyber Security. This Regulation is implemented by MM/FSK and also applies to other RKS institutions, identified as audience participants in trainings as well as operators of essential services and providers of digital services.
– Approved the Administrative Instruction for Determining Procedures for the Destruction of Illegal Structures. This Administrative Instruction, in implementation of the Law on the Agency for Comparison and Verification of Property, clarifies the procedures related to the return of the property right through the destruction of illegal structures, as a tool implemented by the Agency and in the service of the implementation of the judgments of the Supreme Court.
– Reviewed the report on the Ex-Post Evaluation of the Construction Law.
– Appointed Fortuna Haxhikadrija, Faton Osmanin and Armend Behlulin as members of the Board of the Regional Water Company RWC Gjakova, Sh. A.
– Approved the decision on the obligation of the General Secretary of the OPM to open the Competition for the Board of the Independent Commission for Mines and Minerals. With this decision, the General Secretary of the Prime Minister’s Office is obliged to publish the announcement of the competition for the Board of the Independent Commission for Mines and Minerals within seven days.
– Approved the Framework of Indicators for Human Rights in the Republic of Kosovo, as an essential part of the Human Rights Program. Through these indicators, we will evaluate the compatibility of the criteria with those of the European Union and the Council of Europe, and we will enable harmonization with European and international standards in the field of human rights. This framework of indicators also serves to update and improve national systems for monitoring the implementation of human rights.
– Amended and completed the National Action Plan 2023-2025 within the Partnership for Open Government. After membership in the international organization Open Government Partnership (OGP), completion and amendment of the Action Plan is also required.
– Establishment of the Early Warning Mechanism for Monitoring Migration Trends. This inter-institutional mechanism aims to monitor the trends of migration movements after visa liberalization with the European Union; to collect and analyze data related to the movement of citizens of the Republic of Kosovo in the countries of the Schengen area; as well as to recommend taking measures for the relevant institutions in order to successfully manage the process. It functions as a mechanism within the Governmental Authority for Migration (AQM).
– Allocated 6,103,590.00 euros for the implementation of Measure 2.2 – Support to businesses for access to finances of the Economic Revival Package.
– 4 million euros allocated for the provision of aid for recovery from the natural disaster/floods that occurred in the Republic of Kosovo in the months of September 2022 and January 2023 in the municipalities of the Republic of Kosovo.
– Allocated 5 million euros for the implementation of Measure 3.7 – Support in overcoming the energy crisis of the Economic Revival Package to the Kosovo Fund for Energy Efficiency for the implementation of projects that are foreseen for 2023 and 2024.
– Approved the amount of partial contributory pensions according to the following formula: The value of the basic age pension plus the annual coefficient multiplied by the number of full years of contributions.
– Allocated for 36,203,700.00 euros for contributory pensions, payments for maternity and child allowances, payment of remaining obligations for subsidies in agriculture, as well as payment of remaining obligations for treatment outside public health institutions.
– Approved the decision to request the President of the Republic of Kosovo to grant authorization to the First Deputy Prime Minister, for European Integration, Development and Dialogue, for the signing of “Amendment No. 3 of the Financial Agreement between the Republic of Kosovo and the European Union for the IPA Program 2015”. The purpose of the amendment of this agreement is to enable the postponement of the deadline for the implementation of the projects of this agreement for two additional years.
– Approved the decision to ask the President of the Republic of Kosovo to grant authorization to the Minister of Justice, for the signing of the Agreement between the European Union and Kosovo for participation in the Justice program. With this agreement, funds and projects will be provided for Kosovo in order to support judicial cooperation in civil and criminal matters, cooperation through information technology in law, training for judges and other legal practitioners, as well as effective access to justice for citizens and businesses.
– Approved the initiative for the connection of the Credit Agreement between the Republic of Kosovo represented by the Ministry of Finance, Labor and Transfers and the Saudi Development Fund for the Prishtina-Mitrovica Highway Project. This project will enable the connection of the capital with the city of Vushtrri and Mitrovica through the construction and rehabilitation of the second main road, transforming it into a highway with two lanes on each side.
– Approval of the initiative for the conclusion of the Film Co-Production Agreement between the Government of the Republic of Kosovo and the Government of the Republic of Bulgaria. This agreement is of particular importance for the film industry of the two countries, the Republic of Kosovo and the Republic of Bulgaria, and will contribute to the economic growth of the film, television, and video and new media production and distribution industry in both countries.
– Expropriated for the public interest of the former social real estate “Sharrprodhimi” for the realization of the Project: “Construction of the Green Zone – Public Park for the needs of the Community”, Cadastral area; Bresanë, Dragash Municipality.
– Expropriated for public interest the immovable properties affected by the implementation of the Project: “Program for Solid Waste Management II-IV”.
– Expropriated for public interest the former social real estate N. Sh. “Progres” which is necessary for the realization of the Project: “Cemetery of the City of Prizren.
– Expropriated for public interest the immovable properties that are affected by the realization of the project: Protection and Management of Cultural Heritage, Conservation and Investment in the “Archaeological Site of Dresnik” part of the heritage under permanent protection, Cadastral Zone Dresnik, Municipality of Klina.
– Amended and completed Final Decision No. 05/160 dated September 15, 2023 for expropriation in the public interest of real estate affected by the implementation of the Project: Renovation and Reconfiguration of the Olympic Stadium “Adem Jashari” Cadastral Area in Mitrovica. This amendment was made in order to realize the payment of the properties by the Ministry of Culture, Youth and Sports.
– Amended and completed Final Decision No. 11/162 dated September 27, 2023 for expropriation in the public interest of real estate affected by the implementation of the Project: Expansion of the “National Judo Center” Sports Complex in Peja.
– Completed and amended the Regulation on allowances for employees in the health sector.
– 46,110.00 euros allocated to Radio and Television of Kosovo, which will serve to cover expenses from the organization of the “Rrno per me tregue (Live to tell)” concert.
– An additional budget of 40 million euros was allocated to the Ministry of Defense, thus increasing the overall budget for defense to over 200 million euros or over 2% of the Gross Domestic Product. It has also allocated 12 million euros for the agricultural sector, and another 1.8 million euros for RWC Gjakova in order to make the water supply network functional in Mamushë and surrounding villages.
– Established the inter-institutional working group for the prevention and reporting of early marriages in the Roma, Ashkali and Egyptian communities. This working group that will deal with the prevention and reporting of early marriages, and with this we prove our commitment that every girl – and every child – in Kosovo will have their rights and that we work against any form of violence on the basis gender, today and every other day.
– Approved the decision to allocate a one-time allowance of 100 euros to all children who currently receive child allowances under the existing scheme as of December of this year. There is no need to apply for this supplement. The funds will be transferred to the account of parents, mainly mothers who are beneficiaries of regular allowances. For their execution, there will be a special announcement from the Ministry of Finance, Labor and Transport.
– Approved the decision for the one-time supplement of 100 euros for all the beneficiaries of the pension schemes for the month of December. The allowances will be executed after the regular pensions have been executed.
