138th meeting of the Government

The Government of the Republic of Kosovo held its regular meeting in which:

• Completed and amended the Legislative Program of the Government of the Republic of Kosovo for the year 2023 by adding the draft laws as follows:

1. Draft Law on the Harmonization of Special Laws with Law No. 05/L-087 for Misdemeanors (ZKM), deadline for approval in the Government 30.11.2023;
2. The draft law for the completion and amendment of special laws related to the creation of the legal basis for the issuance of by-laws by ministers (ZKM), deadline for approval in the Government 15.11.2023;
3. Draft Law on the Harmonization of Special Laws with Law No. 08/L-067 for Inspections (ZKM), deadline for approval in the Government 15.11.2023;
4. Draft Law on the Harmonization of Special Laws with Law No. 04/L- 202 for the System of Permits and Licenses (ZKM), deadline for approval in the Government 15.11.2023;
5. Draft Law on Value Added Tax (VAT), deadline for approval in the Government 20.12.2023;
6. Draft Law on Personal Income Tax (MFPT), deadline for approval in the Government 20.12.2023;
7. Draft Law on Corporate Income Tax (MFPT), deadline for approval in the Government 20.12.2023;
8. Draft Law on Weapons (MIB) deadline for approval in the Government 31.07.2023;
9. Draft law on the amendment and completion of Law no. 05/l -015 for Notification (MIB), deadline for approval in the Government 30.06.2023
10. Draft Law on Inspection in the Field of Environment, Water, Nature, Spatial Planning, Construction and Housing (MMPHI), deadline for approval in the Government 30.11.2023;
11. Draft Law on Vehicles (MMPHI), deadline for approval in the Government 05.12.2023;
12. Draft Law on the Production, Presentation and Sale of Tobacco and Similar Products (MINT), deadline for approval in the Government 30.06.2023.

• Approved the Draft Law on the Ratification of the Financial Agreement between the Republic of Kosovo and the European Union for the IPA 2022 Program. The agreement enables the Republic of Kosovo to benefit from 62.25 million euros from the European Union, which will be applied to the return and re-integration projects of communities, support for free professions in Kosovo, approximation instruments and support for the environment and green energy. This support of the European Union through the IPA is considered as a special contribution to strengthen the European integration process of the Republic of Kosovo, especially helping to achieve the obligations arising from the Stabilization and Association Agreement. The total amount of dedicated funds, including funds from the European Union, donors and the contribution from the Government of the Republic of Kosovo, is 91 million and 830 thousand euros.

• Approved the draft law on the Representation of State Institutions in Judicial and Arbitration Procedures. This Draft Law defines the rules for the representation of state administration institutions in judicial and arbitration proceedings, it also regulates the operation and powers of the State Bar, as well as the legal status of the municipal attorney. Last week, the Republic of Kosovo scored the third victory in a row in the international arbitration, saving 145 million euros from the claimed value. Today’s draft law contributes to the further strengthening of justice institutions.

• Approved the Legal analysis for the simplification, merger or elimination of permits and licenses within the Ministry of Education, Science, Technology and Innovation, the Ministry of Finance, Labor and Transfers, the Ministry of Culture, Youth and Sports, the Ministry of Justice and the Ministry of Economy.

• Approved the Regulation on the Performance Management System for Agencies in the Framework of State Administration.

• Approved the Administrative Instruction for amending and supplementing the Administrative Instruction for Special Measures for the Registration of Joint Real Property in the Name of both Spouses. Article 9 of the Directive is amended and the implementation of the Directive will last for a period of 8 (eight) years from the day of entry into force. During the year 2022, 4375 couples across the country have benefited from this affirmative measure, registering the property free of charge in the name of both spouses. This affirmative measure has helped to increase women’s access to property and for the first time we have reached the rate of ownership by women at the national level in percentage of 19.22%.

• Appointed April 14 as Memorial Day of Survivors of Sexual Violence during the Last War in Kosovo. This decision was also taken in coordination with the President of the Republic of Kosovo.

• Allocated 287 thousand euros for one-time financial compensation for the delegates of the 1990 legislature. These funds will be allocated proportionally to the deputies who participated in the Assembly of Kosovo on July 2, 1990 and September 7, 1990, as and continued to participate in the meetings of the Assembly until May 24, 1992.

• 5.5 million allocated for the implementation of measure 2.2 – Business support for access to finance, of the Economic Revival Package.

• Updating the State Strategic List for Military Goods, referring to the European Union List for goods that are controlled for reasons of national security, foreign policy, public security or for reasons of human rights.

• Reallocated budget funds to the Ministry of Local Government Administration in accordance with the 14 agreements of understanding for capital projects signed by the Minister of Local Government Administration, Mayors of Municipalities and Donors. For this purpose, 3.5 million have been allocated and will be used for the realization of 14 projects, which are also signed in the memorandums of understanding for capital projects signed between the Minister of the Ministry of Local Government Administration, the mayors and donors.

• Reallocated 2.17 million euros to the Ministry of Culture, Youth and Sports for the implementation of the Program “Preventive measures – emergency interventions in different municipalities”.

• Allocated 20,000 euros as contributions to the Cardinal “Domeniko Bartolluqi” foundation, as partial financing of the orchestral concert, which will be held on June 21, 2023 in the Vatican, with the aim of promoting the Republic of Kosovo.

• Dismissed the management board of Public Enterprise Trainkos Sh.A., and a new interim board has been appointed until a new board is selected. The composition of the new temporary Board is as follows:
